These Platform Terms and Conditions (“Terms”) govern access to and use of the FiberWay platform.
Please read them carefully. By creating an Account, accessing, or using the Platform, you agree to be bound by these Terms.
FiberWay operates a digital platform and marketplace designed to support visibility, data-sharing, communication, and connection across agricultural and fiber supply chains.
Through the Platform, FiberWay enables Farmers, Brands, and Spinners to discover one another, share information, and explore potential sourcing or collaboration opportunities. FiberWay may also provide tools, data, insights, and Services to support informed decision-making and responsible sourcing.
For clarity:
- FiberWay does not purchase, own, or resell fiber, and does not take ownership or title to any goods exchanged between Users.
- FiberWay does not guarantee that connections made through the Platform will result in transactions, commercial outcomes, or specific results.
- Except where expressly agreed in writing, FiberWay does not act as a buyer, seller, or contracting party in transactions between Users.
FiberWay’s role is to facilitate access, transparency, and structured interaction through the Platform and Marketplace, while commercial decisions and contractual relationships remain directly between the participating Users.
1. Definitions
“Account” means a User account created on the Platform that enables access to features, Content, or Services, whether as a Free Account or Paid Account.
“Administrator” means FiberWay personnel or authorized representatives responsible for operating, moderating, and managing the Platform.
“Brand” means any company or organization that designs, develops, sources, manufactures, markets, or sells products that incorporate natural fibers or fiber-derived materials, including but not limited to textile, fashion, beauty, personal care, home, wellness, or industrial applications, and that registers an Account on the Platform.
“Content” means any information, data, text, images, videos, documents, or other materials submitted, uploaded, generated, or displayed on the Platform by Users or by FiberWay.
“Ecosystem” means the interconnected environmental, agricultural, and social elements associated with a Farm, including soil, water, biodiversity, climate conditions, land use, farming practices, and human activities.
“Farm Data” means information related to a Farmer’s operations, practices, production, environmental and social indicators, certifications, or activities, whether provided directly by the Farmer, shared during interviews or advisory interactions, observed during farm visits, collected through Services, or generated through Platform tools, forms, or processes.
“Farmer” means an individual, cooperative, farming entity, or producer group engaged in agricultural production and farm management, including the cultivation of natural fibers and/or other crops or farming activities, that creates, or has created on its behalf by FiberWay, a Profile on the Platform.
“FiberWay” means FiberWay Source Ltd., together with its affiliates, subsidiaries, and authorized partners, acting as the owner and operator of the Platform.
“Farm” means the agricultural system managed by a Farmer, including land, fields, natural areas, infrastructure, practices, crops, livestock, and related activities, whether dedicated to natural fiber production or other agricultural uses.
“Free Account” means an Account that provides access to a limited set of Platform features at no cost, subject to usage limits, visibility restrictions, or other conditions determined by FiberWay from time to time.
“Indicators” means qualitative or quantitative metrics, criteria, or measures used to describe, assess, or illustrate environmental, social, production, or sustainability-related aspects of a Farm, its Ecosystem, or agricultural activities, as defined or applied by FiberWay from time to time.
“Marketplace” means the section of the Platform that facilitates visibility, discovery, and connections between Farmers, Brands, and Spinners, without FiberWay acting as a buyer, seller, agent, or broker.
“Paid Account” means an Account that provides access to additional Platform features or Services in exchange for payment or subscription, as determined by FiberWay from time to time.
“Platform” means the FiberWay digital platform, including any associated websites, dashboards, tools, forms, applications, interfaces, APIs, or digital services made available by FiberWay from time to time.
“Profile” means a digital representation of a User or Farm on the Platform, including associated information, Content, and data displayed according to Platform rules, access levels, and moderation standards.
“Services” means any advisory, data collection, certification support, marketplace assistance, impact analysis, storytelling, or other professional services provided by FiberWay, whether free, paid, pilot-based, or subscription-based.
“Spinner” means any company or organization involved in the spinning, processing, or transformation of fibers that registers an Account on the Platform.
“Subscription” means a paid plan that grants access to specific Platform features or Services for a defined period, subject to applicable fees and terms.
“Third Party” means any individual or entity that is not FiberWay or a User, including certification bodies, laboratories, auditors, service providers, or external platforms.
“User” means any individual or legal entity that accesses or uses the Platform, including Farmers, Brands, Spinners, and Administrators.
“Verified Impact Data” means structured, analyzed, or aggregated data derived from Farm Data through FiberWay’s methodologies, tools, or processes, intended to reflect environmental, social, or sustainability-related indicators.
2. Platform Role
FiberWay provides a structured digital platform and marketplace that supports data collection, impact tracking, visibility, communication, and interaction between Farmers, Brands, and Spinners.
The Platform enables Farmers to share information about their Farms, practices, and Ecosystems, including the collection, structuring, and presentation of Farm Data and Indicators. FiberWay may support this process through tools, methodologies, reviews, and Services designed to improve transparency and comparability across the supply chain.
FiberWay’s role is limited to providing the Platform, Marketplace, and related Services. Commercial decisions, certifications, and contractual relationships remain directly between the participating Users.
3. Eligible Users & Accounts
3.1 User Types
The Platform may be accessed by:
- Farmers
- Brands
- Spinners
- Administrators
3.2 Account Creation
- Farmers may self-register or have Profiles created on their behalf by FiberWay
- Brands and Spinners may register Accounts directly
- FiberWay may create or manage Accounts for operational, pilot, or Marketplace purposes
Account creation does not guarantee access to all Platform features.
4. Profiles & Visibility
4.1 Profile Creation
Profiles may be created by Users or by FiberWay on their behalf. FiberWay controls:
- profile structure
- required fields
- presentation and visibility
4.2 Visibility Rules
- Farmer Profiles may be visible without identifiable details by default
- Visibility of names, contact information, and detailed data depends on:
- User type
- subscription level
- applicable consent
FiberWay may restrict access to certain information at its discretion.
5. Free & Paid Access
5.1 Free Accounts
Free Accounts provide limited access to Platform features at no cost, subject to conditions determined by FiberWay from time to time.
5.2 Paid Accounts & Subscriptions
Paid Accounts may provide expanded access to Platform features or Services.
FiberWay may introduce or modify subscriptions, pricing, or access tiers at any time. Free access does not guarantee continued availability of any feature.
6. Marketplace & Communications
6.1 Marketplace Use
The Marketplace facilitates discovery, introductions, and communication between Users. FiberWay does not guarantee that Marketplace interactions will result in transactions or commercial outcomes.
6.2 Platform Communications
FiberWay may require that introductions, initial communications, negotiations, or transaction-related interactions between Users occur through Platform or Marketplace tools, particularly where such interactions relate to Marketplace access, Services, or applicable fees or commissions.
Once a relationship or transaction has been established, Users may communicate outside the Platform, provided that such communication does not intentionally circumvent the Platform, Marketplace rules, or applicable fees.
7. Fees & Commissions
FiberWay may charge fees or commissions in connection with:
- Marketplace introductions
- Transactions facilitated through the Platform
- Services provided to Users
Applicable fees, commission structures, and payment responsibilities will be disclosed prior to confirmation of any transaction or Service engagement.
7.1 Circumvention
Users agree not to intentionally circumvent the Platform or Marketplace to avoid applicable fees or commissions related to introductions or transactions initiated through FiberWay.
8. Transactions Between Users
Any transaction, contract, or agreement resulting from Platform use is entered into directly between the participating Users.
FiberWay may support communications or data sharing but does not sign contracts on behalf of Users and does not guarantee performance, delivery, or payment.
9. Data, Indicators & Insights
9.1 Informational Use
Farm Data, Indicators, and Verified Impact Data are provided for informational purposes only.
FiberWay does not provide legal, financial, certification, or regulatory advice and is not a certification body.
9.2 Accuracy
Data reflects the information available at the time of collection and may change. Users remain responsible for verifying information before relying on it.
10. Content & Consent
Users retain ownership of their Content.
Farmers may provide explicit consent for:
- profile visibility
- use of photos, videos, and storytelling
- aggregated or anonymised insights
Media or storytelling use is limited to approved contexts and active relationships, where applicable.
11. Moderation & Enforcement
FiberWay may review Profiles prior to approval, request corrections, or suspend or remove Profiles or Accounts.
Where reasonably possible, FiberWay will notify affected Users and provide guidance.
12. Existing Relationships
FiberWay does not claim ownership of, or interfere with, existing relationships or contracts between Farmers and Buyers.
However, use of the Platform and Marketplace remains subject to these Terms, including applicable communication, visibility, and fee rules where interactions or transactions are initiated or facilitated through FiberWay.
13. Services
Certain Services may be governed by separate agreements, scopes of work, or proposals.
These Terms continue to apply to any Platform use connected to such Services.
14. Suspension & Termination
Users may stop using the Platform at any time.
FiberWay may suspend or terminate access where necessary to protect Platform integrity, address misuse, or comply with legal obligations.
15. Exit & Data Retention
Upon exit:
- Profiles are removed from visibility
- Data may remain anonymised
- Farmers may request deletion, subject to legal or operational requirements
16. Platform Changes
FiberWay may modify features, access rules, or availability. Where reasonable, notice will be provided.
17. Limitation of Liability
To the maximum extent permitted by law, FiberWay is not liable for lost sales or opportunities, pricing outcomes, certification results, or business decisions made based on Platform information.
18. Governing Law
These Terms are governed by the laws of England & Wales.
Jurisdiction is non-exclusive, allowing claims in other competent courts where required.
